What is the S1003 purpose code?

Purpose code S1003 is used when an Indian business sends money abroad to pay for operational leasing services without operating crew, including aircraft and other charter hire arrangements with foreign lessors. It covers recurring or time-based lease payments for aircraft, equipment or vessels where the lessor provides the asset but not the crew or operational management. It does not apply to financial leasing structures that are treated like asset purchases, or to leases that include operating crew or full service, which fall under different RBI purpose codes. Under RBI FEMA guidelines, this outward payment is classified under other business services and reported accordingly.

When to use S1003 purpose code?

Use S1003 when you are paying an overseas lessor or owner for operational leasing services without crew, such as aircraft or equipment charter hire for your business in India. It is the correct RBI purpose code for lease or charter payments where you only hire the asset and continue to operate and staff it yourself. S1003 covers the service of leasing the asset, not a financed purchase or leasing arrangement that effectively transfers ownership.

When to use a different code:

  • Use the operational lease-with-crew purpose code when the payment is for a charter or lease that includes operating crew and full operational services
  • Use the financial leasing purpose code when the payment is for a lease that is in substance a financed asset purchase
  • Use the matching P code when you are receiving money rather than paying

Who typically uses S1003 purpose code?

Indian airlines, cargo operators and charter companies that take aircraft or other aviation assets on operational lease without crew from overseas lessors, as well as Indian corporates that hire foreign-owned equipment or vessels on a bareboat or similar basis. It applies whether you pay as an airline, large corporate, logistics company, MRO or other business entity, as long as the leasing service is provided from outside India and the operation remains with you.

Examples of transactions covered

  • Monthly lease rental to a foreign aircraft leasing company for an aircraft operated by your Indian airline without any crew provided by the lessor
  • Payment to an overseas owner for bareboat charter hire of a vessel used by your Indian logistics or shipping business
  • Periodic rental to a foreign lessor for operational leasing of ground support or industrial equipment that you operate with your own staff in India
  • Lump sum or advance payment to an international charter company for time-based hire of an aircraft or helicopter without operating crew for corporate use

When NOT to use S1003 purpose code

  • The payment is for a lease or charter that includes operating crew and full operational services rather than just the asset (use the operational lease-with-crew purpose code)
  • The payment is for a financial leasing arrangement that is effectively a financed asset purchase (use the appropriate financial leasing or capital account purpose code)
  • The payment is for outright purchase of an aircraft, vessel or equipment instead of an operational lease (use the relevant import of capital goods or asset purchase purpose code)
  • You are receiving money rather than paying (use the matching P code)

Documents required

To send a payment under S1003, keep the following documents ready so your authorised dealer bank can verify the transaction and report it correctly under FEMA.

DocumentPurpose
Form A2 with PANThe standard outward remittance declaration with your PAN and purpose code S1003 stated clearly.
Form 145Income-tax declaration under Rule 220 for the overseas lease or charter payment, with Form 146 from your CA where required.
Vendor invoiceLease rental or charter hire invoice from the foreign lessor, clearly mentioning the asset, period, terms and that it is without operating crew.
Lease or charter agreementExecuted operational lease or bareboat / charter hire contract that sets out the terms, tenure, payment schedule and responsibilities of each party.

How is a S1003 Purpose Code declared?

Declaring the code is pretty straightforward. Here's how the payment gets tagged and reported.

  1. Receive the lease invoice: Your overseas lessor or charter hire provider bills you, clearly describing the operational lease or bareboat charter without crew.
  2. Determine taxability: Establish whether the lease or charter payment is chargeable to tax in India, since that decides which part of Form 145 you file.
  3. File Form 145: Submit the declaration before remitting, with Form 146 from your CA where the taxable amount exceeds ₹5 lakh in the Tax Year.
  4. Complete Form A2: State the purpose of the outward remittance as S1003 and submit the supporting documents to your bank.
  5. Get your MT103: Once the payment is sent, request the SWIFT MT103 as proof and retain your Form A2 record.
  6. With a traditional bank you handle each step of the payment journey. But with a platform built for cross-border payments, you can preselect a default purpose code so the payments go out smooth.

Common mistakes to avoid

A few common slips can hold up your payment or cause compliance issues. Here's what to watch for.

  1. Mixing up lease types: Tagging a financial lease or a lease that includes operating crew under S1003 instead of the correct financial leasing or full-service charter code.
  2. Code and invoice mismatch: The code not matching what your vendor invoice describes, such as using S1003 when the invoice covers a purchase or a crewed charter, which flags the payment.
  3. Assuming a Rule 220(3) exemption: Skipping Form 145 on an operational lease payment that is not on the specified exemption list, which carries a ₹1,00,000 penalty per instance.
  4. Incomplete documents: Missing lease agreement, invoice or Form A2, so the bank holds the remittance until provided.
  5. Missing PAN or KYC: Incomplete verification stops the bank from releasing the payment.
  6. Using an outward code for an inward receipt: Applying S1003 to money coming in instead of the matching P code for lease income received.

Frequently asked questions

S1003 is the RBI purpose code for outward payments from Indian businesses to foreign suppliers for operational leasing services without operating crew, including aircraft and other charter hire arrangements. It covers recurring lease rentals or time-based hire payments where you hire only the asset and operate it yourself, such as aircraft taken on operational lease by Indian airlines from overseas lessors. Using the correct code helps your bank classify the remittance properly under FEMA and the balance of payments reporting.
