What is the S0013 purpose code?

Purpose code S0013 is used when an Indian business or resident investor sends money abroad to repay a short term loan taken from a non-resident, where the original loan maturity was up to one year. It covers scheduled repayments, prepayments or bullet settlements of eligible short term borrowings from foreign lenders, group entities or other non-resident parties. It does not apply to repayment of longer term external commercial borrowings, which fall under different capital account codes. Under RBI FEMA guidelines, this outward payment is classified under capital account and reported accordingly.

When to use S0013 purpose code?

Use S0013 when you are repaying a short term loan with an original maturity of up to one year that you previously borrowed from a non-resident lender. It is the correct RBI purpose code for returning principal or interest on such short term foreign loans, whether you are an Indian company or a resident individual investor, as long as the borrowing itself complied with RBI rules. S0013 covers repayment of the loan, not receipt of the loan or any unrelated capital transfer.

When to use a different code:

  • Use the code for longer term external commercial borrowings when the original maturity exceeds one year
  • Use the appropriate capital account code for repayment related to equity, quasi equity or other investment instruments
  • Use the matching P code when you are receiving money rather than paying

Who typically uses S0013 purpose code?

Indian companies, LLPs and other business entities that have taken compliant short term loans from overseas group entities, foreign banks or other non-resident lenders and are now repaying them. Resident individual investors who have borrowed short term from non-residents in line with FEMA and RBI guidelines may also use this code when remitting repayment abroad.

Examples of transactions covered

  • Repayment of a six-month working capital loan taken from a foreign group company
  • Bullet repayment at maturity of a one-year short term loan from an overseas bank
  • Early prepayment of the outstanding balance on a short term foreign currency loan from a non-resident lender
  • Transfer of funds to a non-resident individual to settle a compliant short term loan extended to an Indian resident

When NOT to use S0013 purpose code

  • The repayment is for a foreign loan with original maturity of more than one year under an external commercial borrowing facility
  • The payment relates to buying or selling equity, compulsorily convertible instruments or other capital market investments
  • The transfer is a personal remittance or gift to a non-resident rather than repayment of a documented loan
  • You are receiving money rather than paying (use the matching P code)

Documents required

To send a payment under S0013, keep the following documents ready so your authorised dealer bank can verify the transaction and report it correctly under FEMA.

DocumentPurpose
Form A2 with PANStandard outward remittance form where you declare S0013 as the purpose and provide your PAN and KYC details.
Form 145Income-tax declaration for foreign remittances, filed before sending the funds so your bank can act on it.
Loan agreement and drawdown detailsThe executed short term loan agreement with the non-resident, along with a statement of disbursements and the repayment schedule.
RBI or bank approvals and filingsAny applicable FEMA approvals, return filings or bank clearances that evidence the loan’s compliance and permitted repayment terms.

How is a S0013 Purpose Code declared?

Declaring the code is pretty straightforward. Here's how the payment gets tagged and reported.

  1. Review the loan documents: Check your short term loan agreement, repayment schedule and any RBI or bank approvals to confirm the amount and due date.
  2. Verify regulatory filings: Ensure any required FEMA or RBI filings for the short term loan have been completed and are consistent with the repayment you plan to make.
  3. File Form 145: Submit the declaration before remitting, with Form 146 from your CA where the taxable amount exceeds ₹5 lakh in the Tax Year.
  4. Complete Form A2: State the purpose of the outward remittance as S0013 and submit the supporting documents to your bank.
  5. Get your MT103: Once the payment is sent, request the SWIFT MT103 as proof and retain your Form A2 record.

Common mistakes to avoid

A few common slips can hold up your payment or cause compliance issues. Here's what to watch for.

  1. Wrong capital code: Tagging a repayment of a longer term external commercial borrowing or investment-related transfer under S0013 instead of the correct capital account code.
  2. Code and invoice mismatch: The code not matching what your loan or repayment documents describe, which flags the payment.
  3. Assuming a Rule 220(3) exemption: Skipping Form 145 on a payment that is not on the specified list, which carries a ₹1,00,000 penalty per instance.
  4. Incomplete documents: Missing loan agreement, repayment schedule or Form A2, so the bank holds the remittance until provided.
  5. Missing PAN or KYC: Incomplete verification stops the bank from releasing the payment.
  6. Using an outward code for an inward receipt: Applying a payment code to money coming in instead of the matching P code.
